WHAT IS A LEGAL COMPLIANCE AUDIT?

A Legal compliance audit is a systematic review of your organisations’ compliance with applicable legislation. Indlovu Health and Safety can assist you with an audit to check your compliance with the Occupational Health and Safety Act 85 of 1993 and all its regulations applicable to your organisation.

WHY SHOULD MY ORGANISATION BE AUDITED?

All employers should comply with the Occupational Health and Safety Act 85 of 1993 and the

regulations which are applicable to your business. The only way you will be able to provide evidence of compliance is to have your business audited by a registered Health and Safety Professional.

An Occupational Health and Safety Act compliance audit is usually undertaken to determine if your working environment complies with the requirements as set out in the Occupational Health and Safety act 85 of 1993 and its regulations applicable to your organisation.

A compliance audit will identify shortcomings if any with the legislative requirements. It can also help you measure any progress between your last and current health and safety compliance audit. This could act as a test of the effectiveness of your health and safety system.

HOW OFTEN SHOULD AN AUDIT BE DONE?

The frequency of compliance audits is general prescribed by the client. The industry standard is that a compliance audit be done at least annually.

HOW LONG DOES IT TAKE TO PERFORM SUCH AN AUDIT?

The duration of an Occupational Health and Safety Act compliance audit depends on the size of your organisation and the scope of the audit. Accompanying the physical audit is a written audit report. Time allocated for the preparation of such a report is one day for each day on site performing the physical audit.

CAN ANYONE PERFORM SUCH AN AUDIT?

MY ORGANISATION WAS AUDITED, WHAT NOW?

Following a successful audit, a certificate of compliance will be issued to your organisation. This certificate can be displayed with pride, in a public place at your workplace for all your stakeholders to see.

In addition to being legally compliant and to reduce the risk to which your organisation might be exposed to, you can furthermore use this compliance audit report and certificate to include when applying for tenders, discounted insurance rates from selected insurance companies and submission as part of your organisations registration application with government entities like the Department of Higher Education and Training.
